承租人能否將租賃權讓予他人?

按最高法院三十七年上字第六八八六號判例意旨「租賃關係之成立與存續,係基於當事人間之信任,故租賃權通常為不得讓與之債權,如房屋之承租人未得出租人之同意,擅將租賃權讓與第三人時,其情形有甚於全部轉租,出租人自得終止租約。」,一般出租人於決定訂定租賃契約時,均會考量承租人之目的,使用方法與支付能力,故租賃契約之屬人性甚重,如允許承租人於訂約後,得將租賃權讓與他人,不啻變相剝奪出租人選擇承租人之權利,對於出租人之權利將有所損害,故參照上揭見解,承租人非得出租人同意,應不得將租賃權讓與他人。
