屋主虛設租賃關係以阻擾強制執行,債權人如何救濟?

按強制執行法第九十八條規定「拍賣之不動產,買受人自領得執行法院所發給權利移轉證書之日起,取得該不動產所有權,債權人承受債務人之不動產者亦同。前項不動產原有之地上權、永佃權、地役權、典權及租賃關係隨同移轉。但發生於設定抵押權之後,並對抵押權有影響,經執行法院除去後拍賣者,不在此限。」、第九十九條「債務人應交出之不動產,現為債務人占有或於查封後為第三人占有者,執行法院應解除其占有,點交於買受人或承受人;如有拒絕交出或其他情事時,得請警察協助。第三人對其在查封前無權占有不爭執或其占有為前條第二項但書之情形者,前項規定亦適用之。依前二項規定點交後,原占有人復即占有該不動產者,執行法院得依聲請再解除其占有後點交之。前項執行程序,應徵執行費。」,故拍賣之不動產於查封前經出租人出租者,法院於查封時將不排除承租人之占有,拍定人亦須承受該租賃關係,此即所謂「拍定後不點交」之不動產,實務上此種不動產之拍賣價格較低,拍定之機會亦不高,故債務人為避免所有之不動產遭法院拍賣,常會設定虛偽租賃關係以為阻撓,此時債權人如能證明債務人與承租人間租賃契約係通謀虛偽,自得訴請法院確認債務人與承租人間虛偽租賃契約為無效;倘債權人係不動產抵押權人,而債務人所訂定租賃契約成立在後
